Re-Qualification Course

This DOT / SAP Re-Qualification course is designed to meet the continuing education requirements outlined in 49 CFR: Part 40; Subpart O, 40.281(c) (3) (d).

The course is designed to provide participants with a comprehensive understanding of the revised alcohol and drug testing procedures and to clearly define the role and responsibilities of the substance abuse professional. The revised DOT rules became effective August 1, 2001 and the substance abuse professional must meet the revised mandated criteria by no later than December 31, 2003. 

After January 1, 2004, in order to be permitted to act as a substance abuse professional in the Department of Transportation alcohol and drug testing program, the revised rules require the substance abuse professional to meet each of the following requirements;          

          a.       must have the appropriate credential(s), (subpart O, 40.281(a)
          b.       basic Knowledge related to the DOT Rules       
          c.       qualification Training that includes nine (9) subject areas
          d.       satisfactorily complete a written examination
          e.       maintain continuing education related to the nine subject areas
          f.        maintain documentation that supports meeting the above criteria

Goals/Objectives

By the end of this course participants are expected to be able to: 

1.     Describe the background, rationale, and coverage of the DOT drug testing program

2.  Explain 49CFR part 40 and the DOT drug and alcohol testing rules 

3.  Identify key DOT drug testing requirements including

a.     collection

b.     laboratory testing

c.     MRO review

d.     problems in drug testing 

4.     Identify key DOT alcohol testing requirements including

          a.       the testing process

          b.       the role of BATs and STTs

          c.       problems in alcohol testing 

5.  Define the SAP qualifications and prohibitions 

6.  Explain the role of the SAP and the return-to-duty process including

          a.       the initial employee evaluation

          b.       referrals for education and/or treatment

          c.       follow-up evaluation

          d.       continuing treatment recommendations

          e.       the follow-up testing plan 

7.  Discuss the role of the SAP in consultation and communication with employers, MROs, and treatment providers 

8.  List the reporting and record keeping requirements 

9.  Identify the issues that SAPs confront in carrying out their duties 

10. Meet the continuing education requirements relevant to performing SAP functions.

Tom Foley is the Executive Director of Professional Training Center, Inc., an organization that specializes in training employers, supervisors, and behavioral health professionals on issues related to the Department of Transportation’s Drug and Alcohol Testing Program. The organization helped develop the DOT/SAP written examination for the International Certification and Reciprocity Board for Alcohol and Drug Abuse Professional Counselors.  

Tom also is the President and Chief Executive Officer of Tom Foley Associates, Inc., a training organization located in the State of Michigan. He has designed and presented more than forty training topics to more than 8,000  behavioral health professionals. He was one of the key trainers in the federally funded Project for Addiction Counselor Training, PACT, and in 1998 he received the "Quality Service Award" for his outstanding contribution in the field of behavioral health  training.  

Tom has been in the behavioral health field for nearly thirty years. He has a Master's Degree in Human Services and is certified as an addiction counselor and clinical supervisor at the IC&RC level through the Michigan Certification Board for Addiction Professionals. His background also includes clinical and  administrative experience as a clinician, clinical supervisor, and program director.
